These terms and conditions help to keep this website a safe place to trade and set out the full extent of any agreement reached between you and www.goldhawksbasketball.com in connection with this site.
You should understand that by placing an order, you accept the following terms and conditions:
Your contract for purchases made through this web site is with Goldhawks Basketball.
You agree that e-mail can be used as a long-distance means of communication.
No contract for the sale of any product or service will subsist between you and Goldhawks Basketball unless and until Goldhawks Basketball accepts your order by way of an e-mail confirming that it has received payment in full for all the goods/ services you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Goldhawks Basketball sends the e-mail to you (whether or not you receive that e-mail). This confirmation (not request) e-mail amounts to an acceptance by Goldhawks Basketball of your offer to buy goods and/or services from Goldhawks Basketball or a 3rd party supplier that is engaged on your behalf by Goldhawks Basketball.
You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.
Goldhawks Basketball will not pass on your personal or credit or debit card details to any third party.
You undertake that all details you provide to Goldhawks Basketball for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
If there are any changes to the details supplied by you it is your responsibility to inform Goldhawks Basketball as soon as possible.
Goldhawks Basketball does not accept liability for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services.
Goldhawks Basketball will do its best to correct errors and omissions as quickly as practicable after being notified of them.
Goldhawks Basketball do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the www.goldhawksbasketball.com website or for any products or services purchased from Goldhawks Basketball.
Goldhawks Basketball will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim.
Processing of orders
All prices include sales taxes (where applicable) unless otherwise stated.
Every purchase you make shall be deemed performed in the United Kingdom. The law of the United Kingdom shall govern every aspect of contractual agreement concerning purchases made from this web site.
Goldhawks Basketball aim to arrange shipment of all in stock items within 24 hours of receiving your order. Your order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable and the current stock status is approximate. You can keep track of your order status yourself on-line with the order tracking facility on the ‘View My Orders’ page.
For all Goldhawks club players paying monthly fees, these will be repeated by Goldhawks Basketball through Sage Pay on the 2nd of every month. The payment amount and duration are present on the Goldhawks website and booking screen.
For all products ordered via the Goldhawks Basketball store, these must be collected in person. They will not be chipped to the customer address.
We are unable to refund any monies for sessions or events missed because of general illness to participants, any holidays taken during the school term, or for missed sessions because of late arrival or non-attendance.
No refunds will be given for cancelling mid-way through a term.
If a cancellation is made 14 days to a Goldhawks activity starting, a 50% discount will be applied.
With some Goldhawks Merchandise orders being bespoke, these items are unable to be returned. However for generic merchandise items, you have a right to cancel your order for any item purchased through our website with or without reason, under the distance selling regulations for refund. If you are unhappy with your purchase we accept only merchandise items with labels still attached, and must be notified to eligible for a refund within 7 days.
Faulty returns must be sent back for inspection before a refund will be issued. If the product is found to have a defect you will be offered a refund or exchange (if available). Returned goods must be adequately sealed in original packaging. Please ensure you ask for a certificate of posting as proof you have sent the package. Royal Mail do charge for issuing a certificate. If you return an item without proof of postage and it is lost in transit we reserve the right not to issue a refund. You are responsible for the item until we receive it therefore we suggest you return the parcel using Royal Mail Recorded (Signed For) Delivery or similar. We will not refund the postage paid by the customer on unwanted returned items only on faulty items.
Customer data, including handling and collection of personal information, is processed in accordance with local law. It will not be passed onto third parties.
Parents/guardians should ensure children arrive no earlier than 5 minutes before the designated start time for the session. We are unable to take responsibility for children who arrive earlier than this. For lunchtime sessions, and sessions run directly after school, coaches will be present in time for the children’s arrival.
If you are late picking your child up from a Goldhawks Basketball session, we reserve the right to leave your child in the safe environment of school with a responsible adult. In most situations, Goldhawks Basketball coaches will wait with the child. However if that coach needs to leave to get to another session, it is understood that they have a responsibility for the children in that later session.
Behavioural Standards and Exclusion
Goldhawks Basketball expects children to behave at all times in a manner that is acceptable to both fellow children and Goldhawks staff. The coach reserves the right to exclude a child from the session for any period of time if he/she continues to disrupt the learning and enjoyment of others. In severe cases, if the child is to be excluded permanently from the club at the coaches discretion, a refund will be issued for the sessions the child will miss in the remainder of the term. A formal email to the parents will be considered as the first warning, with any further action resulting in removal from the class.
Cancellations Due to ‘Circumstances Beyond Our Control’
There may be circumstances beyond our control throughout the year, in which we are unable to run our basketball session(s). Examples of these circumstances include (but are not limited to) severe weather conditions, unexpected school closures or traffic accidents. In such cases no refund will be issued.
Goldhawks Basketball staff have a duty to act if they suspect a child in their care is hurt or may be suffering from abuse, or if a child makes a disclosure about abuse. In such an event, the member of staff will follow the Goldhawks Basketball Child Protection Policy.
Please ensure children do not bring valuable belongings when attending Goldhawks Basketball sessions. We cannot accept liability for lost, stolen or damaged items. Please ensure clothing and other belongings are clearly labelled with the child’s name to help us return unclaimed items. Lost property from school sessions will be handed into the school office.
Photography and Video
We often film and take photographs at our sessions and tournaments that may be used for marketing, promotional, and coaching purposes. If you would rather your child was not included in any photographs, we must be informed in writing before the start of the course.
Goldhawks Basketball Ltd does not accept liability for sickness, personal injury or death of any participants unless directly caused by the proven negligence of the company or its employees. Providers of the facility and their employees are under no liability whatsoever in respect of personal injuries, loss or damage to property whilst attending any Goldhawks Basketball activity.
Participants are covered by our Public Liability Insurance.
Goldhawks Basketball is fully committed to delivering the highest standards of teaching, coaching, camps and other events. We aim to ensure every person has a fantastic experience within our programme. If you are not entirely satisfied with the service we provide, we would like to hear about it. If we are aware of any problem whilst attending a course, we will aim to resolve this at the earliest stage. You can be assured that any complaint will be taken very seriously.
In any instance, the complaint should be made to Goldhawks Basketball Managing Director, Alex Sarama, via firstname.lastname@example.org.
It is a crime to use a false name or a known invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.
Goldhawks Basketball may amend these terms and conditions from time to time, and place the new version on the website. All purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms.
These terms and conditions shall apply when Goldhawks Basketball accepts your order by e-mail confirming that it has received payment in full for all the goods or services you have ordered. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Godlhawks Basketball and you relating to your purchase Goldhawks Basketball advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by Goldhawks Basketball.
